Update on the Work Capability Assessment Judicial Review from Paula Peters
Hi all, just to give some feedback on the wca judicial review......the case was finished yesteday January 18th at 4.15 pm in court room 6 of the upper tribunial courts in London. Yesterday on day three, the hearing concentrated on the barristers representing the dwp thier evidence went on to 3 pm and was horrible to listen to, but, they got a grilling, a roasting and some embarassing silences fom the dwp barristers, at 3 pm the legal team for dm/mm gave a very powerful, impressive counter argument. The dwp legal team mentioend in the mornign about a pilor scheme run in my local area, adn something i knew something about as I have been challneging the south east regional direcotrs of the dwp and was able to get something submitted on the pilot scheme to the legal team for dm/mm that they were very happy to have so the meetings of hard hitting questions and slip ups by the dwp something may have come from it there to counter argue the dwp agrument in the morning. the dwp now have 14 days in which to submit a further peice of evidence, the legal team for dm/mm then have to counter argue it, three indepdent high court justices will be looking at this independently of the tribunial judges....II have to stress that a decsion will not be made immedialtey, there will not be a decsion before 8 weeks and the legal team said a deicsion could take consderaly longer than that....however teh mood of the legal team was positive, and they told everyone to keep positive and keep fighting, they think something will come from this, but we have to wait, all evidence is being seriously considered, DM will keep me up to date with any further developments, wehn I know anything further, will tell you as soon as i find out, take care all and hugs to all of you xxxxxx
