Help please disability discrimination and employment Trubunal

Hi I'm classed as having a mental and physical disability under equality act 2010, applied out of time to ET as was not aware of 3 month time limit disability was accepted by respondents but today the case has been thrown out as my out of time reasoning was not accepted as my evidence was inconsistent as I have memory issues etc that's why I come under the equality act , my question is should I of had to take the stand due to qualifying under this act? My case was not granted the late app discression as it could of been as I'm disabled all because I could cope on the stand. Do I legally have a case to appeal please help !!!! :-((((

From what I know, I'd say no you don't have a chance to appeal. The time limits are set down in Law, and unfortunately not knowing about the time limits is not an excuse.

You may want to contact some specialist solicitors on the issue, my union 'Unite' use Thompsons.

I had a barrister and he was the one that put me in the stand without warning me of this, the solicitor I have says he thinks we will be able to appeal due to me have mental health issues and I should have not been made to give witness was just wondering if anyone had any similar experiences or knowledge on it :-(
